Traffic accidents

If you were injured in a crash, hit by a vehicle, or in a rollover, or you lost a family member in a traffic accident, you have the right to be compensated for all your losses: medical and transportation expenses, the income you lost, emotional harm (daño moral), and the impact on your daily life.

Driving is a dangerous activity, and the law gives the victim special protection: as a general rule, the victim does not have to prove that the driver was at fault (Article 2356 of the Civil Code). The driver, the vehicle owner and, if it is a public service vehicle, the company it is affiliated with may all be liable.

What we do for you

• We study the police accident report (IPAT), the scene sketch, videos and witness statements to establish how the accident happened.
• We identify everyone who is liable and their insurance policies: SOAT (Colombia's mandatory traffic accident insurance), third-party (non-contractual) liability insurance, and the policies of transport companies.
• We file the claim directly with the liable party's insurer, which the law allows the victim to sue (Articles 1127 and 1133 of the Commercial Code).
• We support you through the loss of working capacity (PCL) rating when your injuries leave lasting effects.
• If there is no fair settlement, we take the case to court, including as a victim in the criminal proceedings.

Keep in mind

• If the vehicle was an official one (from the Police, a mayor's office or another public entity), the deadline to sue the State is only two years.
• If the vehicle fled and cannot be identified, ADRES (the government agency that manages Colombia's health system funds) covers medical care and some compensation payments.
• Don't sign settlements or releases (paz y salvo) with the driver or the insurer before you know what your case is really worth.
