Accidents at businesses and venues

Anyone who opens their doors to the public—a shopping mall, a supermarket, a hotel, a restaurant, a gym, an amusement park or an event organizer—has a duty to provide a safe place. If you slipped on an unmarked wet floor, fell because of a staircase or an elevator in poor condition, had something fall on you, or were hurt when a ride failed, you can claim compensation for all your losses.

The same applies in residential complexes (conjuntos residenciales): the property owners' association must keep the common areas in good condition (Law 675 of 2001). And when the harm happens on a sidewalk, a road or a public park because of a lack of maintenance, the claim is against the government entity responsible.

What we do for you

• We quickly request the evidence that tends to disappear: security camera footage, the venue's internal reports and witness contact details.
• We identify who is liable (owner, property manager, tenant or organizer) and their liability insurance policy.
• We file the claim against the liable party and their insurer; if there is no fair settlement, we sue.
• If you were a customer of the place, we also enforce the duty of safety under the Consumer Protection Statute (Law 1480 of 2011).

Keep in mind

• Ask the venue to make a written record of the accident, and ask them to keep the videos as soon as possible: many cameras erase their footage within a few days.
• If the place is public, the deadline to sue the State is two years.
